§ 1 Scope
(1) These General Terms and Conditions apply to all orders placed by consumers and businesses with us via the online shop at gardita.com.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when entering into a legal transaction.
(3) Deviating terms of the customer are not recognised unless we expressly agree to them in writing.
§ 2 Contracting party
The purchase contract is concluded with:
Beesmaster OÜ, Sakala tn 7-2, 10141 Tallinn, Estonia
Registry code 16963686, VAT ID EE102729823
Email: info@gardita.com
§ 3 Conclusion of the contract
(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.
(2) You can add products to the cart and enter your details during checkout. Before submitting, you can check and correct all details. By clicking the button “Place order and pay”, you submit a binding offer to purchase the goods in the cart.
(3) Immediately afterwards you will receive an automatic email confirming receipt of your order. This confirmation of receipt does not yet constitute acceptance of the offer. The contract is concluded when we accept the order by sending a separate order confirmation by email or by dispatching the goods.
§ 4 Contract language and contract text
The contract language is German; this English version is provided for information. We store the contract text and send you the order details and these Terms by email. You can view the Terms on this page at any time.
§ 5 Prices and shipping costs
(1) All prices are final prices in euros and include statutory VAT.
(2) Any additional shipping costs are stated on the product page and shown clearly during checkout before the order is submitted.
§ 6 Delivery
(1) We deliver to the countries available for selection during checkout.
(2) The delivery time is stated on the respective product page. For payment in advance, it begins on the day after the payment order is issued; for other payment methods, on the day after the contract is concluded.
(3) If a product is temporarily unavailable, we will inform you immediately. Any payments already made will be refunded promptly if the goods cannot be delivered.
§ 7 Payment
The available payment methods are shown during checkout. For payment in advance, we will provide our bank details in the order confirmation; the goods are shipped once payment has been received.
§ 8 Retention of title
The goods remain our property until paid in full.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details can be found in our withdrawal policy.
§ 10 Transport damage
If goods are delivered with obvious transport damage, please report the damage to the delivery driver as soon as possible and contact us at info@gardita.com. Failure to do so has no effect on your statutory rights; it simply helps us assert our own claims against the carrier.
§ 11 Warranty
(1) The statutory warranty rights apply.
(2) Our raised beds are made of untreated solid wood. Differences in colour, grain, knots, small drying cracks and slight dimensional changes caused by moisture are natural properties of wood and do not in themselves constitute a defect. Wood used outdoors turns grey over time; this is a natural process.
(3) The size names of our raised beds (e.g. 60 × 60 or 80 × 120) are nominal sizes rounded to the nearest 10 cm. The actual outer dimensions are slightly smaller (e.g. 59 × 59 cm or 79 × 119 cm, height 19 cm). They are stated on the product page and are the binding specification.
§ 12 Liability
(1) We are liable without limitation for damage resulting from injury to life, body or health, in cases of intent and gross negligence, and under the Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 13 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final provisions
(1) The law of the Republic of Estonia applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
(2) Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
